1.Agreement to these Terms
These Terms of Service (“Terms”) are a binding agreement between you and Digital Horsepower, Inc. (“DHP,” “we,” “us”). They govern your use of report.digitalhp.com, our AI Visibility Report and full diagnostic, the intake and scheduling pages on this site, our webinars, and related communications (together, the “Service”).
By submitting a form, booking a call, registering for a webinar, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a law firm or other organization, you agree to these Terms on its behalf and confirm that you have authority to do so. “You” then includes that organization.
If you don’t agree, don’t use the Service.
2.Who may use the Service
You must be at least 18 and must use the Service for business purposes. You may request a report only for a law firm you own, work for, or are authorized to represent.
3.What the Service provides
The Service analyzes how visible a law firm is across traditional search, local and map results, and AI assistants and answer engines, and estimates what that visibility may mean for the firm’s business.
- Preliminary report: a short assessment provided free of charge after you submit the intake form.
- Full diagnostic: a more detailed report that DHP prepares for firms that book a strategy call, or that request one after a webinar or preliminary report. DHP decides at its discretion whether and when to prepare a full diagnostic.
- Strategy calls and webinars: sessions where DHP walks through findings and discusses possible next steps.
The Service is free, and using it creates no obligation to buy anything. Any paid DHP engagement is governed by a separate written agreement, which controls over these Terms for that engagement.
We may change, suspend, or stop any part of the Service at any time.
4.Not legal advice; your professional obligations
DHP is a marketing agency, not a law firm. Nothing in the Service is legal advice, and using it does not create an attorney-client relationship with anyone.
You are solely responsible for making sure your firm’s marketing, advertising, client intake, and communications comply with the rules of professional conduct and attorney advertising rules in every jurisdiction where you practice or advertise, and with other laws that apply to you. Review any recommendation from DHP for compliance before you act on it.
5.Estimates, not guarantees
Reports are based on data gathered at a point in time and on figures you provide. Please understand the following:
- Revenue and opportunity figures are estimates. They are calculated from the business metrics you enter and from modeled assumptions. They are not predictions, promises, or representations of results any firm has achieved. If your inputs are inaccurate, the estimates will be too.
- Visibility changes constantly. Search results and AI-generated answers vary by location, device, user, time, and query wording, and the platforms change how they work without notice. Your results may differ from what a report shows.
- No guaranteed outcomes. DHP does not guarantee any ranking, placement, AI citation, number of leads or cases, or revenue, whether from following a report or from any DHP service.
- Automated content. Reports are generated largely by automated systems, including AI models, and may contain errors or omissions. Verify important findings before relying on them.
6.Information you provide
You agree that information you submit is accurate and that you have the right to share it. Don’t submit client names, case details, or any privileged or confidential client information.
You grant DHP a non-exclusive license to use the information you submit to provide the Service, communicate with you, and improve our methodology as described in the Privacy Policy. We treat your business metrics as confidential under that Policy.
7.Communications
By submitting a form, you agree that DHP may email you about your report and our services. If you give us your phone number and agree to it on the form, you also agree that DHP may call and text that number about your report, bookings, webinars, and our services, including by automated means. Consent to calls or texts is not a condition of receiving a report or buying anything. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of texts or HELP for help, and use the unsubscribe link to opt out of marketing emails.
8.Acceptable use
You agree not to:
- request reports about firms you’re not authorized to represent, or submit false or impersonating information;
- scrape, crawl, or harvest the Service or its reports by automated means, or submit requests in bulk;
- copy, reverse engineer, or attempt to reproduce DHP’s report methodology, or use the Service to build a competing product;
- resell, republish, or commercially distribute reports;
- interfere with the Service’s security or operation, or try to access data that isn’t yours;
- use the Service in violation of any law.
We may refuse, limit, or cancel any request, and suspend access, if we believe these Terms have been violated.
9.Ownership and permitted use of reports
DHP owns the Service and everything in it, including the site, report designs, text, analysis, scoring, methodology, and software. Subject to these Terms, DHP grants you a limited, non-exclusive, non-transferable license to use reports delivered to you for your firm’s internal business purposes, including sharing them with your firm’s partners, staff, and advisors.
Third-party names, logos, and trademarks that appear in reports, including those of search engines, AI platforms, and competing firms, belong to their owners and are shown for identification and analysis only. Their appearance does not imply any affiliation with or endorsement of DHP.
10.Third-party services and data
The Service relies on third-party data and platforms, and may link to third-party sites or use third-party tools for scheduling, webinars, and communications. DHP doesn’t control those third parties and isn’t responsible for their accuracy, availability, or practices. Your use of a third-party service may be subject to its own terms.
11.Disclaimer of warranties
The Service and all reports are provided “as is” and “as available.” To the fullest extent permitted by law, DHP disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. DHP does not warrant that the Service will be uninterrupted, error-free, or secure, or that any report is complete or accurate.
12.Limitation of liability
To the fullest extent permitted by law, DHP and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, cases, clients, goodwill, or data, arising out of or relating to the Service or any report, even if advised of the possibility of such damages.
DHP’s total liability for all claims arising out of or relating to the Service or these Terms will not exceed one hundred U.S. dollars ($100).
Some jurisdictions don’t allow certain limitations, so some of the above may not apply to you.
13.Indemnification
You agree to defend, indemnify, and hold harmless DHP and its owners, employees, contractors, and affiliates from any claims, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or of any law or professional rule, or from information you submit.
14.Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Broward County, Florida, and you and DHP consent to the personal jurisdiction of those courts.
Any claim must be brought within one year after it arises, or it is permanently barred, to the extent permitted by law.
15.Changes and termination
We may update these Terms from time to time. We’ll post the updated version here and change the “Last updated” date. Changes apply from the date they’re posted, and your continued use of the Service means you accept them. We may end or suspend your access to the Service at any time. Sections that by their nature should survive, including Sections 4, 5, 8 through 14, and 16, survive termination.
16.General terms
These Terms, together with the Privacy Policy, are the entire agreement between you and DHP about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn’t a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship.
